Terms & Conditions.

These Terms and Conditions govern your access to and use of the Potatoland website at potatoland.ca (the "Site") and any related services offered by Potatoland ("Potatoland", "we", "us", or "our"). By using the Site or submitting an inquiry through our contact form, you agree to be bound by these Terms.

1. About us

Potatoland is a family-owned food processor operating in Southern Ontario, Canada. We process and distribute fresh potatoes, onions, carrots, and related root vegetables to restaurants, wholesalers, and food producers.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You must not use the Site to transmit any material that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.

3. Information you submit

When you submit a product inquiry through our contact form, you confirm that the information you provide is accurate and that you are authorized to provide it. We use this information to respond to your request and to communicate with you about our products and services. Our handling of personal information is described in our Privacy Policy.

4. Quotes, orders, and pricing

Any product information, descriptions, or indicative pricing on the Site is provided for general reference only and does not constitute a binding offer. All orders are subject to a separate written or verbal agreement between you and Potatoland. We reserve the right to refuse, limit, or cancel orders at our discretion. Availability, cut specifications, pack sizes, and delivery schedules are confirmed at the time of ordering.

5. Intellectual property

All content on the Site, including text, graphics, logos, photographs, and the Potatoland name and branding, is the property of Potatoland or its licensors and is protected by Canadian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

6. Third-party links and services

The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, privacy practices, or availability of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms.

7. Disclaimer of warranties

The Site and all content on it are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Potatoland disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of liability

To the fullest extent permitted by applicable law, Potatoland, its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. Our aggregate liability to you for any claim arising out of or related to the Site is limited to one hundred Canadian dollars (CAD $100).

9. Indemnification

You agree to indemnify and hold harmless Potatoland and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Site or your violation of these Terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Site will be resolved exclusively by the courts of the Province of Ontario, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Your continued use of the Site after any changes take effect means you accept the revised Terms.
